1. Who we are
Beats and Breath LLC is a Delaware limited liability company operating the website at www.beatsandbreath.com, the Beats and Breath mobile application available on the Apple App Store and Google Play, and related live and corporate experiences (collectively, the "Services"). 2. Information we collect
We collect the following categories of information:
- Information you provide. Name, email, phone, company, position and message content when you submit our contact, free-session or corporate inquiry forms; account details if you create an account in the app; payment details processed by our payment processor (we do not store full card numbers).
- Usage and device information. IP address, approximate location derived from IP, browser type, operating system, device identifiers, referring URLs, pages viewed, session duration and crash diagnostics.
- Audio session usage. Which Sonic Breathwork™ sessions you start, complete and replay, plus playback preferences (volume, pause/resume points). We do not record your microphone, voice or breath audio.
- Cookies and similar technologies. Strictly necessary cookies for authentication and security, plus privacy-respecting analytics cookies. See Section 7.
3. How we use information
- To deliver, maintain and improve the Services.
- To send transactional emails (free-session access, account notices, receipts) and, with your consent, marketing emails you can unsubscribe from at any time.
- To respond to inquiries, provide customer support and resolve disputes.
- To detect, prevent and address fraud, abuse and security incidents.
- To comply with legal obligations and enforce our terms.
- For aggregated, de-identified analytics that never re-identify you.
4. Legal bases (EEA / UK users)
Where the GDPR or UK GDPR applies, we rely on (a) your consent for marketing communications and non-essential cookies, (b) performance of a contract to deliver the Services you request, (c) our legitimate interests in operating, securing and improving the Services, and (d) compliance with legal obligations.
5. How we share information
We do not sell your personal information. We share information only with:
- Service providers who process data on our behalf under written contracts that restrict their use to our instructions — for example, MailerLite for email delivery, Apple and Google for app distribution and in-app purchases, cloud hosting and analytics providers, and a payment processor if and when payments are enabled.
- Legal and safety recipients when required by law, subpoena, court order, or to protect the rights, property or safety of Beats and Breath, our users or the public.
- Business transfers in connection with a merger, acquisition or sale of assets, with notice to you and continued protection of your information.
6. International transfers
Beats and Breath operates in the United States. If you access the Services from outside the United States, your information will be transferred to, processed and stored in the United States. Where required, we use Standard Contractual Clauses or comparable safeguards for international transfers.
7. Cookies and analytics
Our website uses three categories of cookies and similar technologies. Strictly-necessary cookies (authentication, security, load balancing) are required for the site to function and are always on. Analyticscookies help us understand aggregate, anonymous usage so we can improve the experience. Marketing cookies, where applicable, measure the effectiveness of campaigns. Analytics and marketing cookies are off by default and only run after you opt in via our cookie banner.
You can change your choice at any time using the "Cookie preferences" link in the site footer, which re-opens the banner with your previous selections pre-loaded. You can also disable cookies in your browser; doing so may break some site functionality.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, port, restrict or object to our processing of your personal information, and to withdraw consent at any time. California residents have additional rights under the CCPA/CPRA, including the right to know, the right to delete, the right to correct, and the right to opt out of "sales" or "sharing" (we do not sell or share for cross-context behavioral advertising). Delaware residents have rights under the Delaware Online Privacy and Protection Act (DOPPA) and the Delaware Personal Data Privacy Act (DPDPA). To exercise any right, email support@beatsandbreath.com. We will respond within the time required by applicable law.
9. Data retention
We retain personal information for as long as needed to deliver the Services and for legitimate business or legal purposes — typically the life of your account plus a reasonable period afterward. You can request deletion at any time, subject to our legal obligations to retain certain records.
10. Security
We implement administrative, technical and physical safeguards appropriate to the sensitivity of the data we process, including encryption in transit, restricted access controls and audit logging. No system is perfectly secure, and we cannot guarantee absolute security.
11. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with information, email support@beatsandbreath.com and we will promptly delete it.
12. Changes to this policy
We may update this policy from time to time. Material changes will be communicated by updating the "Last updated" date and, where required by law, by a more prominent notice or email.
